Welcome to IcedScents. By accessing or using icedscent.com or placing an order with us, you agree to these Terms of Service. Please read them carefully.
1. Who we are
IcedScents operates icedscent.com from Brooklyn, New York, United States. Throughout these terms, “we,” “us,” and “our” refer to IcedScents, and “you” refers to the person using the site or placing an order.
2. Eligibility
You must be at least 18 years old, or the age of majority in your state, to make a purchase. By placing an order you confirm you meet this requirement.
3. Products and descriptions
We describe our products as accurately as we can, including scent notes, ingredients, and sizes. Colors may appear differently depending on your screen, and scent is subjective — what we describe may not match your personal experience.
We reserve the right to modify or discontinue any product without notice.
4. Fragrance inspiration and trademarks
Our products are inspired by well-known fragrances. We are not affiliated with, endorsed by, sponsored by, or connected to any of the brands referenced on this site. All trademarks, brand names, and product names mentioned belong to their respective owners and are used only to describe the scent profile of our products.
We do not sell counterfeit goods. Our products are original formulations.
5. Skin sensitivity and safe use
Our products contain fragrance oils and are intended for external use only.
If you have sensitive skin, allergies, or a history of skin reactions, review the full ingredient list before use and perform a patch test on a small area first. Discontinue use immediately if irritation, redness, or discomfort occurs, and consult a healthcare provider if symptoms persist.
Keep out of reach of children. Avoid contact with eyes. If contact occurs, rinse thoroughly with water.
6. Not a medical product
Our products are cosmetics, not drugs. They are not intended to diagnose, treat, cure, or prevent any disease or condition. Any statements about our products have not been evaluated by the Food and Drug Administration.
7. Pricing and payment
All prices are in U.S. dollars and may change without notice. We make every effort to display accurate pricing, but errors happen. If a product is listed at an incorrect price, we reserve the right to cancel the order and issue a full refund.
Payment is processed at checkout. We accept the payment methods displayed at the time of purchase.
8. Orders
Placing an order is an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If we cancel an order you’ve already paid for, we’ll refund you in full.
9. Shipping and returns
Shipping terms are set out in our Shipping Policy. Return and refund terms are set out in our Refund & Return Policy. Both are incorporated into these Terms by reference.
10. Your account
If you create an account, you’re responsible for keeping your password secure and for all activity under your account. Notify us immediately if you suspect unauthorized use.
11. Site content
All content on icedscent.com — text, photographs, graphics, logos, and design — is owned by IcedScents or licensed to us, and is protected by copyright and trademark law. You may not copy, reproduce, or republish it without our written permission.
12. Reviews and submissions
If you submit a review, photo, or comment, you grant us a non-exclusive, royalty-free right to use, display, and reproduce it in connection with our business. You confirm the content is your own and doesn’t infringe anyone else’s rights.
We may remove any submission at our discretion.
13. Prohibited use
You may not use this site to violate any law, infringe anyone’s rights, transmit malicious code, scrape or harvest data, or interfere with the site’s operation.
14. Third-party links
Our site may link to third-party websites. We don’t control them and aren’t responsible for their content, policies, or practices.
15. Disclaimer of warranties
Our site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We don’t warrant that the site will be uninterrupted, error-free, or free of harmful components.
16. Limitation of liability
To the fullest extent permitted by law, IcedScents and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or our products.
Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.
Some states don’t allow certain limitations of liability, so parts of this section may not apply to you.
17. Indemnification
You agree to indemnify and hold IcedScents harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.
18. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction.
19. Severability
If any part of these Terms is found unenforceable, the remaining provisions stay in full effect.
20. Changes to these Terms
We may update these Terms at any time. Changes take effect when posted to this page, and the “Last updated” date will reflect the revision. Continued use of the site after changes means you accept them.
